1. SCOPE

These General Terms of Use apply to any visit or use of the Application by an internet user (hereinafter referred to as "User")

By visiting or using the Application, the User acknowledges that he/she has read these General Terms of Use and expressly accepts the rights and obligations set out therein.

By way of exception, the provisions of the General Terms of Use may be waived by written agreement. Such waivers may consist in the amendment, addition or deletion of the provisions to which they relate and shall not affect the application of the remaining provisions of the General Terms of Use.

We reserve the right to modify our General Terms of Use at any time and without prior notice, but we undertake to apply towards a User the provisions that were in force at the time the User used the Application.

2. APPLICATION

a. Accessibility and navigation

We take all reasonable and necessary measures to ensure the proper functioning, security and accessibility of our Platform. However, we cannot provide an absolute guarantee of operation and our actions should therefore be considered to be covered by a resource commitment.

Any use of the Application is always at the User's own risk. We are therefore not liable for damages that may result from eventual malfunctions, interruptions, defects or even harmful elements on the Application.

We reserve the right to restrict access to the Application or interrupt its operation at any time, without prior notice.

b. Content

Eiyou Finance largely determines the content of the Application and takes great care with the information on it. We take all possible measures to keep our Platform as complete, accurate and up-to-date as possible, even when the information on it is provided by third parties. We reserve the right to modify, supplement or delete the Application and its content at any time, without incurring any liability to do so.

Eiyou Finance cannot offer any absolute guarantee regarding the quality of the information on the Application. As a result, this information may not always be complete, accurate, sufficiently accurate or current. Consequently, Eiyou Finance cannot be held liable for any damage, direct or indirect, that the User may suffer as a result of the information provided on the Application.

If certain content of the Application violates the law or the rights of third parties or is contrary to morality, we request each User to inform us as soon as possible by e-mail so that we can take appropriate measures.

Any download from the Application is always at the User's own risk. Eiyou Finance is not liable for damages, direct or indirect, resulting from such downloads, such as loss of data or damage to the User's computer system, which are the sole and exclusive responsibility of the User.

c. Services reserved for registered Users

1) Registration
Access to the Application is limited to Users who have completed registration on the Application.

Registration and access to the Application's services are reserved exclusively for natural persons who are legally competent, after completing and validating the registration form when installing the Application and accepting these General Terms of Use.

At the time of registration, the User undertakes to provide correct, complete and up-to-date information about himself. The User must also regularly check the information relating to him/her to ensure its accuracy.

Thus, the User must provide a valid e-mail address to which the Application will send him/her a confirmation of registration to our Services. An e-mail address cannot be used more than once to subscribe to the Services.

Any communication from the Application and its partners is therefore deemed to have been received and read by the User. The latter therefore undertakes to regularly check the messages received at this e-mail address and, if necessary, to reply within a reasonable period of time.

Only one registration per person is also permitted.

The User is assigned an identification code that allows him/her to access the Application and a space reserved for him/her (hereinafter the "Personal Space"), subject to entering his/her password.

The password can be changed by the User online in his/her Personal Space. The password is personal and confidential. The User undertakes not to disclose it to third parties.

In any case, Eiyou Finance reserves the right to refuse a request to register for the Application in case of non-compliance with these General Terms of Use by the User.

2) Unsubscribe
Regularly registered Users may request to unsubscribe at any time by going to the dedicated page in their Personal Area. Any unsubscription from the Application will be effective as soon as possible.

3. LINKS TO OTHER WEBSITES

The Application may contain links or hyperlinks to external websites. Such links do not automatically imply a relationship between Eiyou Finance and the external website or even that there is an implicit agreement with the content of these external websites.

Eiyou Finance has no control over such external third-party websites.

We are therefore not responsible for the safe and correct operation of the hyperlinks and their final destination. Once the user clicks on the hyperlink, he/she leaves the Application. We therefore cannot be held liable for any further damage.

4. INTELLECTUAL PROPERTY

The structure of the Application, as well as the content, texts, graphics, images, photos, sounds, videos, databases, computer applications, etc. from which the Application is composed or which are accessible via the Application, are the property of Eiyou Finance or Eiyou Finance has obtained the necessary rights, and as such are protected by the prevailing and applicable intellectual property laws.

Any representation, reproduction, adaptation or partial or full exploitation of the content, brands and services offered by the Application, in any manner whatsoever, without the prior, express and written permission of Eiyou Finance, is strictly prohibited, with the exception of elements expressly designated as 'royalty-free' on the Application.

The User of the Application is granted a limited right to access, use and display the Application a its content. This right is granted on a non-exclusive, non-transferable basis and may only be used for personal and non-commercial purposes. Unless previously agreed otherwise in writing, the User is not allowed to modify, reproduce, translate, distribute, sell or communicate to the public the protected elements in whole or in part

The User is prohibited from entering any data on the Application that would or could alter the content or appearance of the Application.

5. APPLICABLE LAW AND COMPETENT JURISDICTION

These General Terms of Use are governed by Belgian law.

In case of dispute and failing an amicable solution between the parties, the dispute shall be brought before the courts of the judicial district where Eiyou Finance has its registered office.

6. PERSONAL DATA

The personal data are processed by Eiyou Finance, controller, because this is necessary for the operation of the Application, including the provision of info, benefits, actions and events within the User's profile. In the legitimate interest of Eiyou Finance, the personal data are also processed for analysis purposes and may be transferred to profile management partners. The data are not kept longer than necessary to process the purpose for which they were collected. People can exercise their rights of access, rectification, restriction, objection and portability, apply to the DPO and also lodge complaints with the Data Protection Authority.

6.1 Deleting personal data

You can delete your personal data at any time by sending an email to privacy@eiyoufinance.com with the subject "Delete personal data". We will then delete your personal data as soon as possible.

7. OTHER PROVISIONS

Eiyou Finance reserves the right to modify, expand, remove, limit or interrupt the Application and the associated services at any time, without prior notice and without liability.

In the event of a breach of the General Terms of Use by the User, Eiyou Finance reserves the right to take appropriate sanctions and compensation measures. Eiyou Finance reserves the right to temporarily or permanently deny the User access to the Application or our services. These measures may be taken without giving reasons and without prior notice. They cannot entail the liability of Eiyou Finance or give rise to any form of compensation.

The illegality or complete or partial invalidity of any provision of our General Terms of Use will not affect the validity and application of the other provisions. In such a case, we are entitled to replace the provision with another valid provision that serves the same purpose.
